Llançà Town Council – Personal Data Protection Information

The LLANÇÀ TOWN COUNCIL, as the controller of personal data, guarantees an adequate and consistent level of protection for individuals in accordance with the General Data Protection Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018, on Data Protection and Digital Rights.

The Council processes personal data responsibly and lawfully under the legal bases established by the GDPR.
It has created a Record of Processing Activities and implemented appropriate technical and organizational security measures based on assessed risks.
It applies the principle of transparency, providing clear and accessible information and facilitating the exercise of data protection rights.

A Data Protection Officer (DPO) has been appointed under Article 37.1.a) GDPR and Articles 34 and 36 of Organic Law 3/2018.

  1. Legal Bases for Processing

Under the GDPR:

  • Art. 6.1.a) Consent of the data subject (e.g., newsletter subscriptions).
  • Art. 6.1.b) Contract performance or pre-contractual measures.
  • Art. 6.1.c) Compliance with a legal obligation.
  • Art. 6.1.e) Public interest mission or exercise of public authority (e.g., video surveillance).

Under Organic Law 3/2018:

  1. Purpose of Processing

Purposes are specified in the Record of Processing Activities, according to the Council’s legal competences.

  1. Data Retention

Personal data will be retained as long as necessary for its purpose and possible legal responsibilities.
Video surveillance data will follow specific retention rules.

  1. Data Subject Rights

Individuals may exercise their rights of access, rectification, erasure, restriction, objection, and data portability (when applicable).
Requests may be submitted via the Llançà Town Council electronic registry.
If unsatisfied, they may file a complaint with the Catalan Data Protection Authority (apdcat.gencat.cat).

Recipients are listed in the Record of Processing Activities.
They may include other competent public administrations.

  1. International Data Transfers

The Council may use services involving international data transfers to countries with adequate protection recognized by the European Commission or under the EU–US Data Privacy Framework.

  1. Automated Decisions

The LLANÇÀ TOWN COUNCIL does not carry out automated decision-making or profiling.

  1. Data Origin

Data originate from the individuals concerned or their representatives.
If obtained from other public administrations, Article 14 GDPR obligations are observed, including information on data sources and categories.
